Sample Society Gift Memberships Terms & Conditions
SAMPLE SOCIETY GIFT MEMBERSHIPS ("GIFT MEMBERSHIPS" OR "PROGRAM") ARE OFFERED ONLY IN THE UNITED STATES AND IS OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES, WHO ARE 18 YEARS OR OLDER AND HAVE THE REQUIRED LEGAL CAPACITY TO ENTER INTO AN AGREEMENT TO PURCHASE GOODS.
In addition to the terms and conditions set forth herein, Gift Memberships are also governed by the Company's "Sample Society" FAQs on the Website, which is incorporated herein by reference.
- PROGRAM TERMINATION
- Quidsi, Inc. and/or its affiliates (hereinafter the "Company") reserves the right in its sole discretion, for any reason, to terminate all or any portion of the Gift Memberships by giving notice to this effect by means of a posting on the homepage on www.beautybar.com (the "Website") and/or via another method of notice, as deemed appropriate by Company in its sole discretion.
- PROGRAM CHANGES
- You understand that your continued membership with the Company via the Account Agreement and/or your participation in this Program constitutes your consent to, and agreement to, abide by the most current version of these terms and conditions (the "Program Terms"). We may at any time revise these terms and conditions by updating the Program Terms. You agree to be bound by subsequent revisions and agree to review the Program Terms periodically for changes to the terms and conditions. The most up to date version of the Program Terms will always be available for your review on the Websites.
- PURCHASING A SAMPLE SOCIETY GIFT MEMBERSHIP
- Gift Memberships are available in specified monthly increments, as stated on the Website. Upon purchase of a Gift Membership, purchasers will be required to input the email address and/or shipping address of the gift recipient. Purchasers may also choose to enter their own email address. Upon purchasing a Gift Membership, a Gift Membership Code ("Code") will be sent to the email address specified by the purchaser at the time of purchase. Gift Memberships may not be purchased with Company Gift Certificates or Credits. Sales tax may be applied to the Gift Membership purchase, based on the shipping address entered and applicable statutory law.
- REDEEMING A SAMPLE SOCIETY GIFT MEMBERSHIP
- To redeem a Code, recipient's must first open an account and register with the Company through the Website or any of its Affiliated Websites (defined as www.diapers.com, www.soap.com, www.wag.com, www.yoyo.com, www.casa.com www.vine.com, www.afterschool.com, or www.bookworm.com ). Recipients must then redeem the Code by enrolling as a Sample Society member on the Website using the provided Code. Codes, once redeemed, may not be cancelled. If a recipient redeems multiple Codes at the same time, or during overlapping periods, then the gift membership period covered by those Codes will be stacked. For example, if someone redeems two (2) codes on the same day, each for three (3) month gift periods, then that person will receive a six (6) month Sample Society membership. Upon receipt of the Code by the recipient, but before redemption, the recipient may contact Customer Care to obtain a Beauty Bar Credit equal to the price paid by the purchaser for the Code. Beauty Bar Credits may be used to purchase eligible products on www.beautybar.com. Beauty Bar Credits are governed by the Program Terms related to "Conversion and Expiration."
- CONVERSION AND EXPIRATION
- Failure to redeem a Code within 60 days of issuance will result in conversion of the Code into a Beauty Bar Credit. The amount of the Beauty Bar Credit will be equal to the price paid for the Code. Beauty Bar Credits may be used to purchase eligible products on www.beautybar.com. Beauty Bar Credits do not expire. Conversion of Codes into Beauty Bar Credits will result in the Code's forfeiture, the purchaser will not be entitled to a refund and aside from the Beauty Bar Credit, no compensation will be given to either the purchaser or the recipient.
- RISK OF LOSS
- The risk of loss and title for Codes and Beauty Bar Credits pass to the purchaser or recipient upon our electronic transmission to the purchaser or recipient, whichever is applicable. We are not responsible if a Code or Beauty Bar Credit is lost, stolen, destroyed or used without your permission.
- GENERAL TERMS
- Codes and Beauty Bar Credits cannot be sold, redeemed for cash, transferred to another member's account or pooled with Codes and Beauty Bar Credits in another member's account. Codes and Beauty Bar Credits have no cash value. Codes and Beauty Bar Credits are issued by Quidsi Solutions LLC, a Washington Limited Liability Company. When you purchase, receive or redeem Codes and Beauty Bar Credits, you agree that the laws of the State of Washington, without regard to principles of conflict of laws, will govern these Program Terms and Conditions. Company reserves the right to change these Program Terms and Conditions from time to time in its discretion. All Program Terms and Conditions are applicable to the extent permitted by law.
- PRIVACY NOTICE
- Company collects personal data when you participate in this Program. Participation in the Program, and your acceptance of the Terms of Use and/or Account Agreement, constitutes your permission for the Company to maintain the data. The data is collected to, among other things, maintain a record of those who have participated in the Program, to fulfill orders, to properly issue discounts and Credits, Points and Rewards, and for marketing purposes, in accordance with Company's Privacy Policy Statement.
- DISQUALIFICATION
- Company reserves the right, in its sole discretion, to close customer accounts or disqualify any individual it finds, in its sole discretion, to be tampering with the operation of the Program or the Websites, or to be in violation of the Account Agreement, the Terms of Use of the Websites or these Program Terms. Company reserves the right to bill alternative forms of payment if a fraudulently obtained Code or Beauty Bar Credit is redeemed and/or used to make purchases on the Affiliated Websites. Any individual who attempts to defraud Company in any way will also be subject to prosecution to the fullest extent of the law.
- DISPUTES
- Any dispute relating in any way to Codes and Beauty Bar Credits in which the aggregate total claim for relief sought on behalf of one or more parties exceeds $7,500 shall be adjudicated in any state or federal court in King County, Washington, and you consent to exclusive jurisdiction and venue in such courts.
- EXPIRATION AND FORFEITURE
- For the "5% Back" Program, each Reward obtained will expire 60 days after the Reward is deposited into your account. Expiration of such Rewards will result in their forfeiture, and no compensation will be given. For the Familyhood Program, Familyhood Credits earned prior to 11:59 PM EST on October 17, 2012 will expire 24 months after issuance. All other Familyhood Points and Credits will expire at 11:59 PM EST on December 29, 2012. Upon expiration of Familyhood Credits or Points, Credits/Points are forfeited and no compensation will be given. Each credit obtained via the Refer-A-Friend Program will expire within 6 months. Expiration of such credits will result in their forfeiture, and no compensation will be given.
- LIMITATIONS OF LIABILITY
- QUIDSI INC. AND/OR ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO CODES OR BEAUTY BAR CREDITS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT CODES OR BEAUTY BAR CREDITS ARE NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH CODES OR BEAUTY BAR CREDITS. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
- Any attempted participation except as permitted by these Program Terms, is void. Company is not responsible for lost, late, incomplete, damaged, stolen, misdirected, illegible materials, email or mail; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or for garbled or jumbled transmissions, or for service provider/Internet/Website/use net accessibility or availability, traffic congestion, or unauthorized human intervention, or for inaccurate capture of any information, or the failure to capture any such information.
- Company is not responsible for any incorrect or inaccurate information, whether caused by printing errors, Website users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Program, and is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Websites or any communications means. Company is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Program or downloading materials from or use of the Websites.
